La presente investigación tuvo como objetivo realizar un análisis del procedimiento abreviado contemplado en el Código Orgánico Integral Penal (COIP), partiendo del criterio de que ciertos aspectos de este procedimiento vulneran derechos fundamentales del investigado. Se destaca particularmente el requisito para el procesado de admitir los hechos que se le imputan para acceder a este procedimiento, lo cual, según la opinión mayoritaria de doctrinarios, compromete el principio de no autoincriminación, la presunción de inocencia y el derecho a un juicio con (...) todas sus fases. El objetivo de esta investigación fue analizar el procedimiento abreviado establecido en el Código Orgánico Integral Penal (COIP), con el propósito de identificar posibles vulneraciones de derechos fundamentales del investigado. Se buscó específicamente evaluar cómo el requisito de admitir los hechos imputados para acceder a este procedimiento podría afectar principios como el de no autoincriminación y la presunción de inocencia. A través de un enfoque cualitativo y utilizando diferentes métodos de análisis, se procuró determinar si el procedimiento abreviado, tal como está configurado, garantiza un debido proceso conforme a los estándares de derechos humanos y constitucionales. La metodología aplicada se sustentó en un enfoque cualitativo, utilizando los métodos inductivo, analítico, sintético y exegético. Se llevó a cabo un análisis documental de la bibliografía relacionada con el tema investigado, así como de instrumentos internacionales de Derechos Humanos, la Constitución de la República de Ecuador, el COIP y jurisprudencia vinculada a la materia. Los resultados de la investigación determinaron que el procedimiento abreviado tal como se encuentra regulado en el COIP beneficia al Estado y al sistema de justicia al agilizar ciertos procesos legales. Sin embargo, se evidenció que este procedimiento puede vulnerar derechos esenciales del procesado, como el principio de no autoincriminación y la presunción de inocencia. Por lo tanto, se concluye que el procedimiento abreviado afecta el debido proceso al comprometer garantías fundamentales. La investigación señala que el procedimiento abreviado regulado en el COIP, si bien puede ser beneficioso para la eficiencia del sistema de justicia, también conlleva riesgos significativos de vulnerar derechos fundamentales del procesado. Por lo tanto, se destaca la necesidad de revisar y modificar este procedimiento para garantizar el respeto absoluto al debido proceso y a las garantías individuales del investigado. (shrink)

Cancer is a chronic disease that causes the most deaths in the world, being a public health problem nowadays. Even though breast cancer affects the daily lives of patients, many women become resilient after the disease, decreasing the impact of the diagnosis. Based on a positive psychology approach, the concept of co-vitality arises understood as a set of socio-emotional competencies that enhance psychological adaptation. In this sense, emotional intelligence is one of the main protective factors associated with resilience. However, it (...) is not always as beneficial as it seems, and can lead to collateral effects on psychological adjustment. Given this controversy, this study aims to find the specific processes through which the dimensions of Perceived Emotional Intelligence can act as a risk or protective factor in the development of resilience. The total sample was 167 women, 46.7% were breast cancer survivors, and 53.3% were healthy controls. The selection of women with breast cancer carries out randomly, recruited through the Oncology Units. The sample completed measures of resilience and PEI, through Resilience Scale and TMMS-24. The results showed that breast cancer survivors showed higher age and greater levels of resilience and mood repair than healthy women. The mediation analysis revealed that breast cancer survival and PEI predicted 28% of the variance of resilience. The direct effects showed that emotional clarity and mood repair increased resilience levels. Although breast cancer did not predict resilience directly, it does through mood repair by an indirect process. Besides, the analysis showed that emotional attention played a role in vulnerability, decreasing mood repair, and resilience. These research support theories that point to a possible dark side of PEI, thus, a great level of emotional attention makes dark the positive effect of mood repair and personal growth if a clear perception of emotions does not complement it. These results provide empirical support concerning the need to work complementary each dimension of PEI to avoid unwanted effects on intrapersonal adjustment. (shrink)

La característica más representativa de la música es su capacidad de generar emoción. Pero ¿por qué la música emociona? En este artículo mostramos los conocimientos actuales de la teoría musical y la neurociencia que intentan explicar las relaciones que existen entre la música y las emociones. En primer lugar, se repasan los conocimientos actuales sobre el procesamiento de los sonidos musicales a nivel cerebral y las posibles explicaciones del origen de la emoción musical, así como la contribución de los distintos (...) parámetros musicales a la generación de emociones, considerando estructuras musicales de nuestro mundo occidental. En segundo lugar, se presenta el canal táctil como un posible canal de transmisión de la emoción musical análogo al canal auditivo, pero con más limitaciones en la discriminación de frecuencias. Este acercamiento se produce desde la profunda fascinación que ejerce la música, con la esperanza de encontrar vías para explicar la transmisión de la emoción musical desde un canal alternativo. Aim: The presence of noise in urban environments is rarely considered a factor that causes damage to the environment. The primary generating source is transportation means, with vehicles being the ones that affect cities the most. Traffic noise has a particular influence on the quality of life of those who are exposed to it and can cause health alterations ranging from annoyance to cardiovascular diseases. This study aims to describe the relationship between the traffic noise level and the perceived annoyance (...) in the inhabitants of a city on the Northern Border of Mexico. The work carried out in a city represents the vulnerability characteristics: economic, social, and migratory of its sizable portion of the inhabitants. Due to that, it is impossible to identify precisely the number of residents as the number of vehicles in circulation.Methods: The streets and avenues with an annual average daily traffic of more than 1,000 vehicles were considered for the measurement of traffic noise. The equipment used was a vehicle gauge with non-invasive speed radar; type I integrating sound level meters, with their respective gauges and tripods. A questionnaire was applied to people living within 250 m of the streets and avenues in which the noise was measured.Results: The noise measurement found a parameter of LAeq estimated for 12 h during the day, exceeding 70 dBA. The data received from the questionnaire were statistically tested by using Pearson's correlation tests. A total number of 2,350 people were participated, of whom 1,378 were women and 972 were men. The age of participants is ranged from 18 to 75 years. The overall perception of traffic noise annoyance identified that 1,131 participants responded “Yes” as they considered the noise annoying. Participants who responded “No” as well as those who responded “Do not know” resulted in a total of 1,219 people.Conclusion: The results show that the population is desensitized to traffic noise and does not perceive it as an annoyance. The flow of vehicles and the type of vehicles are the significant factors for the propagation and increase in the traffic noise levels. Women present a considerable appreciation of traffic noise perception instead of younger people who demonstrate a higher tolerance to high-level exposure. This reflects the lack of information of the population around the noise problem and its effects. (shrink)

El presente artículo es producto de una investigación multidisciplinaria e interinstitucional, fruto de la alianza entre la Universidad de San Buenaventura Medellín y el Centro de Familia VID-Obra de la Congregación Mariana de Medellín. Surge de una inquietud respecto a la manera en que se aborda la realidad institucional de las madres cabeza de familia, tanto en el ámbito político como empresarial. Para estudiar esta realidad, se partió de un modelo de investigación cualitativo, en donde se hizo una aproximación a (...) la población a partir de un cuestionario que permitiera identificar los roles y percepciones frente al ejercicio de la maternidad y la jefatura femenina, específicamente, cuando se trata de madres trabajadoras. Los resultados arrojados por la investigación permiten obtener una mirada psicosocial de la forma en que se ejerce el rol de madre y de figura de articulación familiar. (shrink)

La segunda parte aborda desde una perspectiva sociocultural la pregunta ¿cómo debe ser una mujer?, desde la premisa (...) de que las prácticas de educación y moldeamiento del cuerpo tienen sentido en la modernidad como una forma de control social. Finalmente se busca, desde una perspectiva política, señalar cómo el “boom” de la estética corporal es un mecanismo de dominación principalmente dirigido a la mujer, al cual las políticas públicas y la legislación no logran dar respuesta, manteniendo a éstas en un lugar pasivo como sujeto y actor político. Durante la última década se ha producido un importante desarrollo de prácticas que formulan propuestas alternativas a los modos de producción, consumo e intercambio dominantes. Este artículo analiza el tejido de prácticas económicas alternativas en la ciudad de Valladolid, una ciudad media alejada de los contextos urbanos sobre los que se ha construido el cuerpo teórico que indaga en el potencial transformador de redes de consumo, mercados de trueque, bancos de tiempo, monedas sociales o huertos comunitarios. El trabajo, consciente del (...) valor del contexto y de la escala, propone para ciudades como la estudiada una relectura que sitúa dicho potencial no en el ámbito económico, sino en el de la práctica y la experiencia social y en el de la cultura política.The last decade has witnessed an important development of practices that involve alternative proposals to the dominant production, consumption and exchange patterns. In the present article, we present an analysis of the interwoven patterns of alternative economic practices in Valladolid, a mid-sized city in Spain. This urban profile differs from the cities that have typically been used to design the body of research on the transformation power that consumer networks, bartering, time banking, social coin and community orchards have. Taking into account the value of both the context and the scale under investigation, this study proposes a reanalysis for these types of cities: under this view, the potential is not placed in the economic sphere but rather in the social practice and experience as well as in the political culture. Nos aproximamos a la óptica sobre el régimen político, económico y social surgido en Venezuela luego de 1958 hasta su colapso en 1998. Sintetizamos la dura crítica formulada por los liberales a las políticas económicas de los gobiernos democráticos. Denuncian la mala administración de enormes recursos, la corrupción, la ineficiencia y el despilfarro. Junto al reconocimiento de que, a pesar de sus fallas, existió la democracia política, se señala la necesidad de reformas en el sentido de aumentar la representatividad, el (...) control ciudadano, la descentralización, la plena vigencia del Estado de Derecho, el libre mercado y la responsabilidad individual. En este texto se analiza el papel de los derechos humanos en la fase actual de globalización, en cuanto herramientas de la libertad política. Su globalización, hasta ahora pervertida por una selección parcial e interesada de lo globalizable -ante todo, el sistema de libre mercado- es imprescindible para el funcionamiento democrático de la nueva organización mundial. Pero para que los derechos humanos sean útiles a tal menester, será necesario en primer lugar, reflexionar sobre los servicios que han prestado al (...) desarrollo y ahora a la globalización del capitalismo. En segundo lugar, es preciso adecuar el discurso de los derechos a las necesidades de quienes padecen los desequilibrios que origina la globalización y convertirlo realmente en un discurso emancipador. Una imprescindible contextualización de los contenidos y condiciones de ejercicio de los derechos -para lo que son imprescindibles derechos sociales y a lo que aún ayuda los Estados-nación- es el corolario de esta reflexión que finaliza con un ejemplo de contextualización del discurso de los derechos a través de los derechos de los consumidores. This paper compares two normative theories of education in Chile, one centered in the republican tradition, mainly in the XIX and partly in the XXth century, and the other imposed by the military dictatorship and who uses the market freedom and the market efficiency as justificatory devices. The republican theory argues in favor of a central role of the state in the design of a public, universal, obligatory and tuitionless educational system, understood as essential to the formation of citizens in (...) common and to the construction of an egalitarian society. One can think of education, in this perspective, as a common property, a public good of which nobody can, in principle be excluded. To the market theory, education is conceived as a consumer good –or, in another version, as an investment– who means high rates of return to individual users and for that reason must be paid by them. From another perspective, a private system of education is justified in terms of the freedom to offer educational goods in the market, and the freedom to choose this goods by theconsumers. In Chile an educational system very similar to the republican one, has existed till 1973. This system has had a relatively peaceful coexistence with private education in all levels. In current discussions on education, this mixed system is considered a good thing. The paper argues that this coexistence is no more possible with the actual market model who seeks to exclude any other system, which is incompatible with a strong public system of high quality and who points therefore to the destatisation of all education. RESUMO:O objeto de estudo deste artigo é a condição humana. Qual a possibilidade de existência da condição humana fundamentada na liberdade? O objetivo é relacionar esfera pública, política, liberdade e condição humana. A elaboração teórica considerou obras de Etienne de La Boétie, Hannah Arendt, Cornelius Castoriadis, entre outros. Na atualidade, ocorre a supressão da condição humana, pois a esfera pública tem a ingerência da esfera privada, predominando a razão instrumental e a lógica do mercado, e o homem é afastado (...) da vida política. Por isso, a nossa ação política pela liberdade é fundamental para a problematização do processo de banalização do mal e da servidão voluntária. A coragem é uma virtude indispensável à ação política, é necessária para nos libertarmos da dominação e do servilismo da vida privada e conquistarmos a vida política. A centralidade da ação política do homem é a sua condição de ser atuante para a reafirmação da esfera pública, do mundo da pluralidade, humano e comum. Todavia, a condição humana fundamentada na liberdade implica a superação da atividade e do pensamento pragmáticos e fragmentários da vida cotidiana e a constituição da praxis na dimensão humano-genérica consciente. ABSTRACT:The subject of this article is the human condition. What is the possibility of the existence of the human condition founded on freedom? The aim is to connect the public sphere, politics, freedom, and the human condition. The works of Etienne de La Boétie, Hannah Arendt, Cornelius Castoriadis, and others, are considered. At the present time there is occurring a suppression of the human condition, because the public sphere exists under the interference of a private sphere in which instrumental reason and market logic prevail. People are divorced from political life. For this reason, political action seeking freedom is essential for addressing the problems of the banalization of evil and voluntary servitude. Courage is an indispensable virtue to political action; it is necessary for liberating us from the domination and servitude of private life, as well as for attaining political life. The centrality of human beings’ political action is the condition for acting to reaffirm the public sphere and the world of plurality, both human and common. However, the human condition founded on freedom supposes the overcoming of the pragmatic and fragmented activity and thinking of daily life, and requires the constitution of praxis in the conscious human-generic dimension. El doble filo crítico que caracteriza la posición de Silvia Rivera Cusicanqui ayuda a hacer un tratamiento de la modernidad hegemónica y sus expresiones por medio de dos movimientos reflexivos simultáneos: el epistemológico y el político. Silvia no realiza su trabajo de investigación a través de las categorías y las herramientas tradicionales, nacidas en la academia elitista que promueve la esterilización política de las reflexiones gracias a investigaciones hiperespecializadas, o realizadas bajo la lógica del mercado de saberes y que (...) es la lógica imperante en las instituciones universitarias. La pensadora andina se dedica a usar instrumentos teóricos cuya base política sea ya de por sí crítica, es decir, no aborda al colonialismo o al patriarcado sólo como temas, sino que lo hace con posiciones anticolonialistas y antipatriarcales. Fue en Inglaterra donde apareció por vez primera un individualismo virtuoso comprometido con la defensa pública de la libertad frente a la amenaza del absolutismo. Allí surgió un discurso político liberal-republicano que defendió que el bien público y el interés privado fueran de la mano. Así, el liberalismo nació como un discurso público y privado de la virtud individual que tenía la vocación de frenar cualquier arrogancia despótica. Pero en la segunda mitad del siglo XX una tendencia neoliberal y libertaria (...) convirtió el mercado en una abstracción dogmática que justificaba un egoísmo descontrolado y sin límites. En Liberales, José María Lassalle expone la necesidad de que el liberalismo del siglo XXI vuelva a los principios virtuosos de sus padres fundadores, John Locke, Adam Smith y Edmund Burke. Los liberales tienen por delante la responsabilidad de enfrentarse a sus propios fantasmas y liderar nuevamente la defensa de una política del deber, y no del beneficio. Una política al servicio de la libertad: preocupada por el c ontrol del poder; que asegure el establecimiento de mecanismos institucionales que impidan la corrupción y las conspiraciones contra el mercado que se urden a las sombras de los gobiernos; que combata el dogmatismo y que defiende la tolerancia como una seña de identidad de nuestra cultura. Ante la mayor crisis de las últimas décadas, urge recuperar la virtud y los valores, una tarea para la que los liberales están mejor capacitados que nadie. (shrink)

A partir da segunda metade do século XX, as políticas econômicas disseminaram um conjunto de dispositivos sutis, no sentido de seu exercício, ao mesmo tempo em que mais plurais, em relação à sua extensão. Um dos principais deslocamentos epistemológicos produzidos pelo discurso neoliberal diz respeito à inserção da subjetividade humana como elemento central da racionalidade econômica. A inclusão da subjetividade na lógica dos cálculos econômicos possibilitou construir a figura do homo oeconomicus como referente antropológico do novo discurso neoliberal. Um dos (...) principais autores nessa jornada é Ludwig von Mises. A teoria misiana é profundamente filosófica: dela é possível coletar toda a estrutura da teoria neoliberal e de seu contraste bifocal entre a ação econômica do mercado e a teoria política do Estado, e nela o homo oeconomicus ocupa um lugar central. A genealogia de Michel Foucault sobre o escopo da governamentalidade neoliberal trouxe um olhar crítico diferente sobre os princípios constitutivos deste discurso. A par da teoria de Mises, a leitura de Foucault nos é precisa, na medida em que nos permite contrastar a razão de governo, constituída ao longo dos modelos de pensamento, com aquela ótica empresarial do homo oeconomicus como um suposto sujeito soberano. O intuito deste ensaio é provocar um cruzamento crítico entre o pensamento de Mises e de Foucault, concentrado principalmente no estudo das contradições que surgem no seio do discurso neoliberal da figura do homo oeconomicus como sujeito soberano, com as práticas de governamentalização desse mesmo homo oeconomicus. O ensaio é constituído de três momentos: primeiramente, nosso objetivo é compreender a teoria do mercado de von Mises, com o intuito de alinhavar alguns conceitos importantes, em especial o conceito de soberania do homo oeconomicus; em seguida, temos como pretensão analisar a teoria de Foucault sobre a governamentalidade neoliberal, acenando em direção ao modo pelo qual a teoria de Mises projeta-se como uma razão econômica de governo; em um terceiro ponto, desenvolvemos algumas implicações derivadas dos cruzamentos das teses sobre a soberania do homo oeconomicus, de Mises, com as análises sobre a governamentalidade desse homo oeconomicus desenvolvidas pelos estudos de Foucault. Prisoners sometimes die in prison, either due to natural illness, violence, suicide, or a result of imprisonment. The purpose of this study is to understand deaths in custody using qualitative methodology and to argue for a comprehensive definition of death in custody that acknowledges deaths related to the prison environment. Interviews were conducted with 33 experts, who primarily work as lawyers or forensic doctors with national and/or international organisations. Responses were coded and analysed qualitatively. Defining deaths in custody according to (...) the place of death was deemed problematic. Experts favoured a dynamic approach emphasising the link between the detention environment and occurrence of death rather than the actual place of death. Causes of deaths and different patterns of deaths were discussed, indicating that many of these deaths are preventable. Lack of an internationally recognised standard definition of death in custody is a major concern. Key aspects such as place, time, and causes of death as well as relation to the prison environment should be debated and incorporated into the definition. Systematic identification of violence within prison institutions is critical and efforts are needed to prevent unnecessary deaths in prison and to protect vulnerable prisoners. (shrink)

ABSTRACT Recently, the hypothesis that purely evaluative disputes are metalinguistic negotiations has gained traction. I resist a strong version of that hypothesis, and argue that some of those disputes are not metalinguistic negotiations. To defend that claim, I argue that metalinguistic negotiations have three linguistic properties that some purely evaluative disputes lack. First, in a metalinguistic negotiation it is felicitous to embed the dispute-initial statement under the subjective attitude verb consider; second, a speaker can reply to that initial statement by (...) using a metalinguistic comparative; and, third, such negotiations address metalinguistic questions under discussion. Some purely evaluative disputes lack these properties, which suggests that they are not metalinguistic negotiations. (shrink)

In this paper, I identify and provide an explanation for a heretofore unrecognized puzzle in feminist aesthetics and the philosophy of horror. Many horror movie fans have an aversion to rape scenes. This is puzzling because genre fans are not equally bothered by the depiction of other types of violence and cruelty. I argue that we can make sense of this selective aversion by appeal to the notion of ‘distance’, which philosophers of horror use to explain why people are attracted (...) to horror movies in the first place. When we consume horror, we ‘distance’ ourselves from the scary things depicted, which allows other mechanisms to kick in that lead to overall enjoyment. I argue that ‘distance’ often collapses when viewers are confronted with depictions of rape because rape is common in real life and a gendered form of violence that is implicated in social injustice. This paper describes a practice innovation: the addition of formal weekly discussions of patients with prolonged PICU stay to reduce healthcare providers’ moral distress and decrease length of stay for patients with life-threatening illnesses. We evaluated the innovation using a pre/post intervention design measuring provider moral distress and comparing patient outcomes using retrospective historical controls. Physicians and nurses on staff in our pediatric intensive care unit in a quaternary care children's hospital participated in the evaluation. There were 60 patients in (...) the interventional group and 66 patients in the historical control group. We evaluated the impact of weekly meetings to establish goals of care for patients with longer than 10 days length of stay in the ICU for a year. Moral distress was measured intermittently and reported moral distress thermometer scores fluctuated. "Clinical situations" represented the most frequent contributing factor to moral distress. Post intervention, overall moral distress scores, measured on the moral distress scale revised, were lower for respondents in all categories, and on three specific items. Patient outcomes before and after PEACE intervention showed a statistically significant decrease in PRISM indexed LOS, a statistically significant increase in both code status changes DNR, and in-hospital death, with no change in patient 30 or 365 day mortality. The addition of a clinical ethicist and senior intensivist to weekly inter-professional team meetings facilitated difficult conversations regarding realistic goals of care. The study demonstrated that the PEACE intervention had a positive impact on some factors that contribute to moral distress and can shorten PICU length of stay for some patients. (shrink)

Oftentimes, reality seems to us a chaos that we try to control with our theories. This article starts from the antithetic standpoint, inspired by Antonio Rosmini’s works: reality is intelligible, and originates our thinking. From this perspective, any research that tries to reach the truth is determined by the real, not the contrary. Moreover, interdisciplinarity, far from being a solipsistic enterprise, aims at achieving truth and guaranteeing scientific advancement. Here, we analyze the distinctive character of Rosminian encyclopedism and his principles (...) for preventing human errors. We then clarify why it is impossible to achieve perfection, and why such an impossibility is not problematic for the interdisciplinary dialogue. (shrink)

ABSTRACT:Ethical research on consumption has focused mainly on the obligations, principles and values guiding consumers' actions and reasons for action. In doing so, it has concerned itself mostly with such bounded contexts as voluntary simplifiers, anti-consumption movements or so-called ‘ethical consumers,’ thereby fostering an artificial opposition between ethical and non-ethical consumption. This paper proposes virtue ethics as a more apt conceptual framework for the ethical analysis of consumption because it takes into account the developmental dynamic triggered by engagement in consumption (...) practices. We build on MacIntyre's goods-virtues-practices-institutions framework and Beabout's concept of a domain-relative practice and argue that when engaging in consumption activities, agents may pursue goods internal to practices, further their individual life narratives and contribute to the good of their communities, thus developing virtues that perfect themselves both as consumers and as ethical agents. Lucia Schwarz urges a reconsideration of the implications of species egalitarianism, which is an essential element of the position in environmental ethics that Paul Taylor calls “respect for nature.” Species egalitarianism’s claim that every living thing has equal inherent worth appears to lead to counterintuitive conclusions, such as that killing a human being is no worse than killing a dandelion. Species egalitarians have generally responded by explaining that species egalitarianism is compatible with recognizing moral differences between killing different types of (...) living things, and that some killing is morally permissible. Schwarz raises doubts about whether this deflationary defensive strategy is philosophically justified, and suggests that taking seriously the supposedly repugnant implications of species egalitarianism may have a salutary effect on the overall debate. ABSTRACT:Ethical research on consumption has focused mainly on the obligations, principles and values guiding consumers' actions and reasons for action. In doing so, it has concerned itself mostly with such bounded contexts as voluntary simplifiers, anti-consumption movements or so-called ‘ethical consumers,’ thereby fostering an artificial opposition between ethical and non-ethical consumption. This paper proposes virtue ethics as a more apt conceptual framework for the ethical analysis of consumption because it takes into account the developmental dynamic triggered by engagement in consumption (...) practices. We build on MacIntyre's goods-virtues-practices-institutions framework and Beabout's concept of a domain-relative practice and argue that when engaging in consumption activities, agents may pursue goods internal to practices, further their individual life narratives and contribute to the good of their communities, thus developing virtues that perfect themselves both as consumers and as ethical agents. La investigación propuesta indagó las relaciones que existen entre el derecho a la memoria y el derecho a la ciudad. Para ello se analizaron desde una teoría crítica de los derechos humanos y teniendo como punto de contacto entre ambos derechos las inscripciones espaciales que materializan la memoria colectiva en la ciudad de Madrid. Es así que se buscó comprobar, desde una dimensión jurídica basada en un enfoque de derechos y con perspectiva espacial, si aquellos lugares que materializan y garantizan (...) la memoria pueden a su vez garantizar el acceso al derecho a la ciudad en virtud de que colaboran en la creación de una ciudad más democrática. La metodología empleada consistió en un análisis crítico de textos, relevamiento y estudio exhaustivo de las normas y estándares nacionales e internacionales, políticas públicas locales, observación y registro de los lugares y, por último, una entrevista en profundidad mediante la técnica de muestra de caso sumamente importante para el problema analizado. I defend a metalinguistic account of Mates's puzzle: sentences where synonymous expressions cannot be substituted salva veritate. If Andrea thinks that attorneys are different from lawyers, and she thinks that Fiona is the former but not the latter, we may hesitate to substitute ‘lawyer’ for ‘attorney’ in ‘Andrea believes that Fiona is an attorney’, even though ‘lawyer’ and ‘attorney’ are synonymous. I argue that these sentences report de re beliefs about linguistic expressions, thereby blocking such substitutions, and I offer a (...) compositional derivation of their meaning. (shrink)

I argue against the view that metalinguistic usage is a form of conversational implicature. That view, suggested by Thomasson (Anal Philos 57(4):1-28, 2016) and Belleri (Philos Stud 174(9):2211–2226, 2017), has been most recently fleshed out by Mankowitz (Synthese 199:5603–5622, 2021). I provide two types of criticism to the implicature view. From an empirical point of view, metalinguistic usage differs in key respects from standard cases of conversational implicature. From a conceptual standpoint, I argue that the calculation algorithm provided by the (...) implicature view makes undesirable predictions. Although my main objective is negative, I end the paper by sketching an alternative neo-Stalnakerian view of metalinguistic usage, that can be gathered from work by Barker (Linguist Philos 25(1):1–36, 2002; Inquiry 56(2–3):240–257, 2013) and others. El artículo presenta los principales resultados de un estudio realizado entre 1998 y 2000 con hombres jóvenes de la Ciudad de Cali, Colombia, profundizando en sus prácticas de distinción en torno al cuerpo, la vestimenta, los espacios de sociabilidad, las mujeres como objetos de ostentación y sus dinámicas de prestigio. El estudio es desarrollado en base a observación participante y a la implementación de entrevistas con grupos de jóvenes entre 14 y 22 años, tanto de sectores medios bajos, como medios (...) altos, e indaga en sus opiniones sobre la moda, el prestigio, la distinción social y los comportamientos que otorgan o quitan el estatus. Considering Rosmini’s political works in comparison with his metaphysical and anthropological essays, and starting from Rosmini's project of a code of law that, in the author’s opinion, can guarantee fundamental human rights, this article discusses the concept of justice between citizens and outsiders. Its first part is an analysis of Rosmini’s juridical fundaments, which takes into account also some objections historically moved against it. Moral distress is a well-documented phenomenon for health care providers (HCPs). Exploring HCPs’ perceptions of participation in moral distress interventions using qualitative and quantitative methods enhances understanding of intervention effectiveness. The purpose of this study was to measure and describe the impact of a two-phased intervention on participants’ moral distress. Using a cross-over design, the project aimed to determine if the intervention would decrease moral distress, enhance moral agency, and improve perceptions about the work environment. We used quantitative instruments and (...) explored participants’ perceptions of the intervention using semi-structured interviews. Participants were from inpatient settings, within three major hospitals of a large, urban healthcare system in the Midwest, United States. Participants included nurses (80.6%) and other clinical care providers. Using generalized linear mixed modeling we assessed the change in each of the outcome variables over time controlling for groups. Interviews were audiotaped and professionally transcribed. The written narratives were coded into themes. The change in scores on study instruments trended in the desired direction however did not meet statistical significance. Qualitative interviews revealed that intervention effectiveness was derived from a combination of learning benefits, psychological benefits, and building community that promoted moral agency. Findings demonstrate a clear link between moral distress and moral agency and suggest that Facilitated Ethics Conversations can enhance the work environment. Findings provide insight for developing evidenced-based approaches to address moral distress of hospital nurses. (shrink)

It has been argued that moral assertions involve the possession, on the part of the speaker, of appropriate non-cognitive attitudes. Thus, uttering ‘murder is wrong’ invites an inference that the speaker disapproves of murder. In this paper, we present the result of 4 empirical studies concerning this phenomenon. We assess the acceptability of constructions in which that inference is explicitly canceled, such as ‘murder is wrong but I don’t disapprove of it’; and we compare them to similar constructions involving ‘think’ (...) instead of ‘disapprove’—that is, Moore paradoxes (‘murder is wrong but I don’t think that it is wrong’). Our results indicate that the former type of constructions are largely infelicitous, although not as infelicitous as their Moorean counterparts. (shrink)
